ASSOCHAM's Bharat Legal Conclave 2023

The legal and regulatory landscape in India is constantly changing owing to the evolving market structure and the advent of technology. The legal domain is also embracing technology with the adoption of tools like AI-powered research platforms, legal analytics, litigation management, ODR etc.  On similar lines, various sectoral commercial laws are inviting stakeholders’ attention so as to align them more effectively with evolving global standards which are aimed towards bringing organizations at par with international best practices. These involve taking into account issues such as environment, sustainable development, and social justice. In addition, a significant rise of digital transactions and data-driven economy has led to an increased focus on data privacy, cybersecurity, and anti-competitive laws.

A significant shift to the virtual platforms for \"Online Arbitration and Mediation Practices\" has taken over traditional mechanisms and has become a new normal. This swift is mitigating the mounted pressure on Courts, comforting the parties in disputes with faster justice delivery set-up. While technology offers efficiency, its adaptation comes with challenges related to data security and equitable access. While one section of the legal fraternity is moving to tech-driven practices in a rapid manner, the other section is still occupied in ensuring that the traditional legal curriculum remains relevant and produces skilled professionals that meet the requirements of the industry. Amongst other challenges is disparity in access to legal services, particularly for the marginalized communities.

The Government of India has moved ahead with decriminalization of over 3,400 legal provisions and reduction of 39000 compliances, and in furtherance, the introduction to 3 new Bills by repealing Indian Penal Code, 1860, Criminal Procedure Code, (1898), 1973 and Indian Evidence Act, 1872. All the laws have significant impact and effect on the economy as they make corporate and industry flourish with greater ease of businesses.
