8th National Workshop on Strategic Commercial Contracts - Drafting, Negotiation, Enforcement

India’s fundamentally strong business environment is backed up by abundant natural resources, growing highly skilled manpower, strong accounting, legal and regulatory system, increasing transparency & governance and most importantly the independent judiciary. However, it is pertinent that numbers of dispute cases have increased multi-fold and parties should be cognizant of the time required to resolve commercial disputes in the country to promote the ease of doing business. Moreover, emphasis should be on bringing the measures to effectively adopt and promote Online Dispute Resolution (ODR) processes across industries and regions in the country. It has become requisite that contracts must be consistent with business requirements because all business transactions are regulated by contracts and agreements. India has been placed at 163rd as of 2020 in the World Bank's indicator for enforcing contracts since on an average it takes about four years to resolve a commercial dispute in India. In addition, parties in litigation spend 31% of the amount in dispute merely to assure that a judgement is delivered.

The protection of organisations' financial resources, reputation and interest against potential legal risks and liabilities out of force majeure or otherwise depends on exposure, ability to assess risks, and foremost vitally the strategic techniques which are followed at the stage of drafting of contracts. Considering immense relevance of the theme, ASSOCHAM’s National Council for Legal Affairs and Regulatory Reforms is hosting 8th National Workshop on “Strategic Commercial Contracts - Drafting, Negotiation, Enforcement” on Wednesday, 24 May 2023 in New Delhi.
